Terms and Conditions: Agreement Between Driving School Rugby and Pupils

Welcome to Driving School Rugby! Take a moment to carefully review the following terms and conditions that outline the agreement between you, the pupil, and your instructor.

​

1. Instructor Information:

Your driving instructor is Peter or Agnes, a driving instructor of Driving School Rugby.

​

2. Lessons Arrangement:

The arrangement for your driving lessons is exclusively between you and your instructor. Both parties should collaboratively determine the lesson schedule, location, and duration to ensure a successful learning experience.

 

3. Communication of Changes:

It's essential to promptly notify your instructor of any changes that could impact your eligibility or ability to receive driving tuition. This includes scenarios like changes in your driving license status.

 

4. Cancellation Policy:

If either party needs to cancel a lesson, a minimum of 48 hours' notice is required. Cancellations should be directly communicated between you and your instructor.

Failure to provide 48 hours' notice may result in charges for the affected lesson(s). Furthermore, the instructor reserves the right to withhold the tuition car on the day of your driving test if your readiness is in question.

​

In rare cases where your instructor is unable to attend a lesson due to illness, vehicle issues, or personal emergency, you will be offered a rescheduled lesson. No financial compensation will be offered for cancellations due to unforeseen circumstances, but every effort will be made to provide advance notice.

 

5. Payment and Reservation:


Tuition fees must be pre-paid through Bank Transfer to your instructor's bank account.

Please be aware that Driving School Rugby cannot be held responsible for payments made through alternative methods. If you opt for a cash payment, it's advised to retain a receipt.

​

6. Refund Policy:

You have the option to request a full refund for amounts pre-paid for unused driving tuition by contacting your instructor.

​

However, certain conditions apply:

  • No refunds will be granted for lessons already taken at the time of cancellation, including the booking fee.

  • If pre-paid tuition is cancelled within 48 hours of the scheduled lesson time, refunds will not be issued for those lessons, including the booking fee.

  • Refunds will ideally be processed using the original payment method. If not feasible, an appropriate alternative refund method will be chosen.

  • Identity verification may be requested for compliance with the Money Laundering Regulations 2007, following the guidelines of Merchant Operating Instructions for card collection facilities.

  • Allow up to 10 working days for refund processing.

  • Partial block booking refunds will be calculated pro rata based on unattended lessons. However, if block bookings were subject to a discount contingent on a minimum lesson count, any taken lessons will be billed at non-discounted pricing if the minimum criteria aren't met.

7. Pupil Conduct

Learners are expected to behave respectfully at all times. Any abusive, threatening, or inappropriate behaviour towards the instructor, other road users, or property may result in the immediate termination of lessons without refund.

8. Price Alterations:

For lessons not pre-paid within a block booking, lesson prices may be subject to change. However, you will always receive prior notice of any adjustments.

For pre-paid tuition, the rate at the time of booking will be honoured for 12 months. Afterward, any remaining unused lessons may be subject to the current lesson price.

​

9. Lesson Transfers:

Lessons purchased in your name cannot be transferred or sold to others without explicit consent from Driving School Rugby.

10. Regular Lesson Requirement and Test Retake Policy:

a. Regular Lesson Requirement:

To ensure that you achieve and maintain the necessary driving standards, it is strongly recommended that you, the pupil, maintain a regular schedule of driving lessons. Consistent practice and training are essential to build your skills and confidence effectively.

b. Test Retake Policy:

In the event that you do not pass your driving test, it is a requirement that you undergo a minimum of 6 additional hours of training with your instructor, before being eligible to schedule another driving test. This post-test training is designed to address any areas of weakness and further enhance your driving abilities, increasing your chances of success in subsequent tests.

 

This policy is in place to ensure that you have the best possible chance of passing your driving test and demonstrating safe driving practices on the road.

 

Please note that the 6-hour minimum training requirement must be completed before attending another driving test, and the scheduling of these additional training hours should be coordinated with your instructor.

11. Use of Driving School Vehicle for Practical Driving Test

If you request to use the instructor’s car for a driving test and have not been taking lessons with Driving School Rugby for more than six (6) weeks, you may be permitted to do so at the instructor’s discretion, subject to an assessment confirming your driving is of test-ready standard.

In such cases, a £500 refundable deposit by bank transfer is required in advance.

  • The deposit will be returned in full if you pass the test on the arranged date and no damage is caused to the vehicle.

  • If the test is unsuccessful, or if any damage occurs to the vehicle while in your care, the deposit will be forfeited.

​

Learners are responsible for managing their own DVSA test bookings. The instructor may advise on readiness, but if a test is scheduled without their agreement, use of the tuition vehicle may be refused.

​​

12. Malicious Damage

Any intentional or malicious damage caused to the driving school vehicle, property, or equipment by a learner will result in the learner being held fully liable for the cost of repairs or replacement. This includes, but is not limited to, damage caused through reckless behaviour, misuse, or deliberate actions.

​

Driving School Rugby reserves the right to recover all associated costs and to terminate any future lessons or agreements with immediate effect if malicious damage is suspected or confirmed.

​

13. Liability and Limitations:

Except in cases of breach of legal duty, foreseeable damage arising from such breach, loss caused by your actions, or circumstances beyond the instructor's control, your instructor, assumes limited liability.

The instructor is not responsible for losses linked to your business interests, such as lost profits or business interruptions.

​​​

14. Preservation of Statutory Rights:

These terms and conditions do not negate any statutory rights you possess as a consumer.

15. Governing Law:

These terms and conditions are governed by the laws of England and Wales.

​​​

16. Acknowledgment of Agreement:

Please ensure your complete understanding and agreement with these terms and conditions before proceeding with your driving lessons. If further clarification is needed or questions arise, please don't hesitate to contact us.
